Please read these Terms of Service (“Terms”) carefully before using the Tether mobile application (the “App”) operated by Zach Lyons (“we,” “our,” or “us”).

1. Acceptance of Terms

By downloading, installing, or using Tether, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Tether is a personal health tracking and journaling application designed to help users:

• Track symptoms, foods, supplements, and daily activities
• Identify potential triggers and patterns
• Access educational health protocols and information
• Interact with an AI assistant for informational purposes

3. User Responsibilities

By using Tether, you agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Not attempt to reverse engineer, modify, or distribute the App
• Not use the App to harm yourself or others
• Take responsibility for all activity under your device

IMPORTANT: Tether is NOT a medical device and does NOT provide medical advice.

• The App is for informational and personal tracking purposes only
• Information provided by the App, including AI responses, is not a substitute for professional medical advice, diagnosis, or treatment
• Always seek the advice of qualified healthcare providers with any questions regarding medical conditions
• Never disregard professional medical advice or delay seeking it because of something you read or learned in this App
• In case of a medical emergency, contact emergency services immediately

5. Intellectual Property

The App and its original content, features, and functionality are owned by Zach Lyons and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App or its content
• Use the App’s branding, logos, or trademarks without permission
• Create derivative works based on the App

6. AI Features

The Cortex AI assistant uses Google’s Gemini API to provide responses. By using this feature:

• You understand AI responses are generated by machine learning and may contain errors
• You agree that AI responses do not constitute professional advice
• You acknowledge that your queries are processed by Google’s services

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your information. Key points:

• Your data is stored locally on your device
• We do not have access to your personal health information
• AI features send data to Google’s Gemini API when used

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT LIABLE FOR ANY HEALTH OUTCOMES RESULTING FROM USE OF THE APP
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY)

9. Indemnification

You agree to indemnify and hold harmless Tether and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of changes by updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Health Disclaimer, constitute the entire agreement between you and PLACEHOLDER regarding the App.
